The Supreme Court of India’s hearing on 20th January 2025 has reignited discussions about Bhai Balwant Singh Rajoana, a prominent figure who remains at the center of one of the most sensitive cases in Punjab’s recent history. Bhai Rajoana stands convicted and sentenced to death for his role in the assassination of Punjab Chief Minister Beant Singh on 31st August 1995, just outside the Punjab and Haryana Civil Secretariat in Chandigarh. With the next hearing now scheduled for 18th March 2025, with directions having been issued to the Union of India to file its affidavit, it is crucial to address certain misconceptions about the case, while highlighting its legal, political, and community significance.

Key Facts About Bhai Rajoana’s Case
No Personal Mercy Petition
Contrary to popular belief, Bhai Rajoana has not personally filed a "mercy petition" with any authority. The petition that is currently under consideration was submitted by the Shiromani Gurdwara Parbandhak Committee (SGPC) on his behalf in 2012. This distinction is significant, as it underscores his unwavering stance of accepting responsibility for his actions.

No Defence or Appeals
During his trial, Bhai Rajoana adopted a unique approach. He did not contest the charges against him, nor did he engage a lawyer to defend him. He openly admitted his role, stating that he was willing to accept any punishment as his actions were, in his opinion, just and aligned with his unwavering principles. Furthermore, he chose not to file any appeals against the Trial Court order in the Punjab and Haryana High Court, or the Supreme Court, maintaining his principled and consistent position throughout the judicial process.

Prolonged Delays and Community Concerns
Bhai Rajoana has been in custody for nearly three decades, and the SGPC’s petition for clemency has been pending for over 12 years. The delay in resolving this matter has raised significant concerns among the Sikh community and legal experts, who view it as a violation of natural justice.

Upcoming Hearing and Its Implications
The Supreme Court has now directed the Union of India to file its affidavit by 18th March 2025, marking a crucial development in this long-pending case, failing which the Apex Court may decide the matter on merits. The Central Government’s response will likely reveal its stance on this sensitive matter and set the tone not only for future proceedings but also in respect of its broader engagement with Punjab and its political parties and pressure groups. The delay has already drawn criticism for reflecting apathy toward the resolution of such high-profile cases, particularly one that holds deep emotional significance for the Sikh community.
